Barton indicated that he would fight for resentencing and that he would coordinate with other jurisdictions to bring forward additional charges against Whiteside, as her crimes allegedly involved taking the child across state lines.
Whiteside was subsequently rearrested on federal charges to which she has pleaded not guilty.
Barton’s office has filed now a motion to resentence Whiteside for her state conviction in light of the fact that two former supporters have come forward to recant their support letters.
The DA alleges that Whiteside “procured this mitigating evidence through means of coercion and deceit.”
According to Barton’s office, the two former supporters indicated that Whiteside had led them to believe she was innocent, and one “described being under constant pressure to submit a letter of support.”

Whiteside will be placed under 24/7 house arrest on a $60,000 unsecured bond while she awaits trial for the federal charges against her.
