Assistant District Attorney Nicholas Frisella characterized Vail’s actions as “pure evil.”

“The allegations are that the sexual misconduct was done over a Bible and used church items as props. I can’t wrap my head around it,” Frisella said.
Vail’s attorney, David Allen, said that Vail plans to appeal his case.
“Yeah, obviously we’re disappointed. But we were pleased that Judge Phillips did vacate five of the seven convictions,” Allen told WALA. “[Vail] has been convicted of two misdemeanors, and he was sentenced to one year consecutive with another year so two years.”
“Like Judge Phillips indicated he is entitled to an appeal bond,” Allen added. “So as soon as he makes his appeal bond he can get out.”
Judge Phillips set Vail’s appeal bond at $5,000.
