TBN countersued in response.
“In an effort to shift blame for their failures to TBN, Peteski and McGraw accused TBN of breaching its obligations under the [contract] and not providing Peteski and McGraw with the resources they needed to produce content for Merit Street,” TBN’s lawsuit alleges.
TBN is suing McGraw for breach of contract and fraudulent inducement, claiming that McGraw knowingly entered the agreement with TBN on the basis of false information.
The suit alleges that McGraw and Peteski engaged in a “years-long fraudulent scheme that they developed and executed to fleece TBN, a not-for-profit corporation, to enrich McGraw, his associates and affiliates.”
“TBN is confident that the truth will set it free, and result in Peteski and McGraw being held accountable for their reprehensible conduct,” the suit continues.
TBN is seeking unspecified monetary damages and a rescission of its deal with Peteski. Earlier this week, TBN filed an emergency relief motion, alleging that Peteski and McGraw had failed to hand over documents that had been ordered by the court.
“We are again confronted with the same discovery failures the Court has already fully addressed,” TBN said in the filing.

If the judge rules in TBN’s favor, McGraw could face a deposition.
