In March, the Trump administration froze $175 million in funding from UPenn. On April 28, the Department of Education’s Office for Civil Rights (OCR) announced that it had found UPenn in violation of Title IX, and on July 1 the department celebrated the resolution agreement with the university.
The July 1 announcement contained quotes from U.S. Secretary of Education Linda McMahon, who praised the “great victory”; former University of Pennsylvania swimmer Paula Scanlan, who called the news a “momentous step”; and Riley Gaines, who said it was a “historic display of [a] promise being fulfilled.”
In a statement, University of Pennsylvania President Dr. J. Larry Jameson said, “This is a complex issue, and I am pleased that we were able to reach a resolution through the standard OCR process for concluding Title IX investigations.”
Jameson maintained that UPenn has always complied with the NCAA’s eligibility rules and with Title IX but that the NCAA’s rules and how Title IX is interpreted have changed over the past several years.
“We have now brought to a close an investigation that, if unresolved, could have had significant and lasting implications for the University of Pennsylvania,” said Jameson. According to CNN, the Trump administration has now unfrozen the $175 million in federal funds allocated for UPenn.
UPenn has agreed to a number of action items in its resolution with the Department of Education. These include that it “will restore to female athletes all individual UPenn Division I swimming records, titles, or similar recognitions which were misappropriated by male athletes allowed to compete in female categories.”
The university agreed to issue a public statement to its community that it will not allow biological males to compete in women’s sports nor to make use of “Penn Athletics female intimate facilities.” It also agreed to use “biologically-based definitions for the words ‘male’ and ‘female,’” and to send apology letters to all female athletes impacted by the university’s previous actions in this area.
